Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Distinction Tuition School ("Distinction", "we", "our", "us") and govern your access to our website, mobile experience, learning content, in-person camping programs and any related services (collectively, the "Service"). By creating an account, paying for any program or otherwise using the Service, you accept these Terms in full. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must provide accurate registration details (full name, phone number, level). You are solely responsible for keeping your account credentials confidential and for every activity that occurs under your account. Sharing your account, password or paid content with any other person is strictly prohibited and is grounds for immediate, permanent suspension without refund.

If you are under 18, a parent or legal guardian must consent to your use of the Service and is jointly responsible for your account, fees and conduct.

2. Subscriptions, fees & "Paid in person"

Tuition is offered on a strictly monthly basis. Access is activated only after a payment has been verified and approved by our team (online Mobile Money, bank deposit or "Paid in person" at our office). Each approved subscription grants access for thirty (30) calendar days from the approval date. Access ends automatically after thirty days unless you renew.

Camping (in-person revision) fees follow the published total for the chosen program and town. Instalments are accepted at our discretion, but the camping seat is only guaranteed once the full amount is recorded as paid in your account.

3. No refunds policy

All payments are final and non-refundable. This includes — without limitation — monthly tuition, GCE per-subject fees, camping fees, partial periods, unused access, content the student chose not to consume, declined enrolments, account suspensions for breach of these Terms, missed classes, technical interruptions on your device or network, change of mind, family or scheduling changes, and failed examinations. By submitting payment you confirm that you have read, understood and accepted this no-refund rule.

4. Content licence & intellectual property

All videos, recordings, notes, past papers, books, branding, software, designs and other materials on the Service are owned by Distinction Tuition School or its licensors and are protected by copyright and other laws. You receive a limited, personal, non-transferable, non-exclusive, revocable licence to access and view the content for your own study during the active period of your subscription. You may NOT:

• download, screen-record, screen-share, mirror, capture or copy any video lesson;
• re-upload, resell, sublicense, rent, redistribute or publicly display any content;
• scrape, crawl, reverse-engineer or attempt to extract source files;
• share your account, password, one-time codes or paid materials with any third party;
• use the Service or its content to train, fine-tune or evaluate any machine-learning model.

Any violation of this Section 4 immediately terminates your licence and your access, without refund, and may be pursued through civil and/or criminal proceedings under Zambian law.

5. Acceptable use

You agree not to misuse the Service. Prohibited conduct includes harassment of other learners or staff, posting unlawful or offensive material, uploading malware, attempting to bypass payment or access controls, impersonating another person, submitting false payment proofs, or using the Service for any unlawful purpose. We may suspend or terminate any account that, in our reasonable opinion, breaches this section — without refund.

6. Payments verification

You authorise us to verify any payment reference, transaction message or proof you submit. Submitting fraudulent or doctored proof of payment is a serious offence: the account will be permanently closed, all access revoked, and the matter may be reported to relevant authorities and mobile-money providers.

7. Service availability

We work hard to keep the Service available, but it is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, secure or virus-free access. We may suspend, modify, upgrade or discontinue any part of the Service at any time, including pricing, content catalogue, programs, camping schedules or features, without liability and without refund of any active subscription.

8. Examination outcomes

Distinction Tuition School is a learning resource. We do not guarantee any particular examination grade, university admission, career outcome or other result. Your results depend on your own effort, consistency and circumstances.

9. Limitation of liability

To the fullest extent permitted by Zambian law, in no event shall Distinction Tuition School, its directors, owners, employees, tutors, contractors or affiliates be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, examination results, opportunity or savings, arising out of or in connection with the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you have actually paid to us in the thirty (30) days immediately preceding the event that gave rise to the claim.

10. Indemnity

You agree to defend, indemnify and hold harmless Distinction Tuition School and its representatives from and against any claim, demand, loss, liability, damage, fine or expense (including reasonable legal fees) arising out of: (i) your breach of these Terms; (ii) your misuse of the Service or content; (iii) your violation of any law or third-party right; or (iv) any content or information you submit.

11. Termination

You may stop using the Service at any time; existing payments remain non-refundable. We may suspend or terminate your account immediately and without notice if you breach these Terms, submit a fraudulent payment, share paid content, harass others, or otherwise harm the platform or its learners. Sections 3, 4, 9, 10 and 12 survive any termination.

12. Governing law & disputes

These Terms are governed by the laws of the Republic of Zambia. Any dispute will be submitted to the exclusive jurisdiction of the courts of Lusaka, Zambia. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.

13. Changes

We may update these Terms from time to time. Material changes will be posted on this page and, where reasonable, communicated through the Service. Your continued use after the changes are posted means you accept them.
